The California Consumer Privacy Act of 2018 (“CCPA”) gives natural persons (defined by the CCPA as consumers) residing in the State of California (“CA Residents”) certain privacy rights regarding personal data collection, use, disclosure and sell of their “Personal Information” (as that term is defined in the CCPA). The CCPA requires that businesses collecting Personal Information from CA Residents give those CA Residents transparency and control of their Personal Information. It should be noted that the definition of Personal Information under the CCPA is broader than the definition of customer Data we have in our Privacy Policy), as the California definition expands to information that can reasonably identify a household and not just identify individuals.

JM Custom Builds LLC (“we”, “us”) work with FrontRow, a Wyoming corporation, to process your Personal Information on our platform (the “Service”). This California Privacy Notice (this “Notice”) is intended to assist CA Residents that use our Service (as defined in our Privacy Policy)) in understanding their rights with respect to their Personal Information. Any terms not defined in this Notice are defined in our Privacy Policy).

  1. Application. The CCPA applies to for-profit businesses that collect and sells Personal Information of CA Residents and that meet at least one of the following conditions:

  2. The business has an annual gross revenue of over $25 million;

  3. The business gathers, buys, sells, or receives the personal information of over 50,000 California residents, households, or devices; or

  4. The business derives more than 50% of annual revenue from selling the Personal Information of CA Residents.

  5. Exemptions. This Notice does not apply to Personal Information we collect about CA Residents in their capacity as one of our employees, contractors, business partners,or as an emergency contact, beneficiary, or dependent of one of our employees, contractors, or business partners. Additionally, this Notice does not apply to any Personal Information exempt from the CCPA, including deidentified information (as defined by the CCPA).

  6. ** Data Processing Addendum.** A key feature in remaining compliant with the CCPA is working with vendors and third party service providers that are also in compliance with the CCPA. Accordingly, we require that all of the vendors and third party service providers that handle any customer Data enter into our Data Processing Addendum (“DPA”), or an agreement of similar form. This DPA sets forth standards that those handling Data must use to comply with the CCPA. We have provided a DPA for you to use with vendors and third party service providers.

  7. **Privacy Policy) and Settings. **As a Member or User of our Service (as those terms are defined in the Privacy Policy)), you will provide us with some of your personal Data. You are not statutorily required to provide personal Data in order to use the Service. But without providing some personal Data, we cannot verify your identity. Additionally, without some Data, you would not be able to order products, and the Service may be less efficient and customized.

**5. CCPA Rights. **Among other rights granted under the CCPA, the CCPA affords CA Residents the following rights:

  • Right to Know. You have a right to know the categories of Personal Information we collect about you, the sources from whom we obtain Personal Information, the purpose(s) for collecting your Personal Information and the categories of Personal Information we are sharing and selling and for what purposes, and the categories of third parties to whom we are sharing or selling your Personal Information. This information can be found in our Privacy Policy).
  • Right to Access. As a CA Resident, you have the right to access the specific pieces of Personal Information we have collected about you in the past twelve months. You have the right to request certain information about our collection, use and disclosure of your Personal Information.
  • Right to Deletion. Subject to certain exceptions, you have the right to request that we delete the Personal Information we have collected from you. You also have the ability to delete your Account (as defined in the Privacy Policy)), in your Account settings. We may decline to delete your Personal Information in some cases as set forth in our Privacy Policy).
  • Right to Data Portability. You have the right to receive a copy of your electronic Personal Information in a readily-usable format to the extent technically feasible.
  • Right to opt out of certain sharing with third parties. We do not sell your Personal Information, as defined under the CCPA. But you do have the right to direct us to stop disclosing your Personal Information to third parties for monetary or other consideration. If, we did at some point sell consumers’ Personal Information, we must give consumers the opportunity to opt-out of the transaction with a clear opt-out option.
  • Right to Opt Out of Sales and Sharing of Cross-Context Behavioral Advertising. You have the right to opt out of our sale of your Personal Information for Cross-Context Behavioral Advertising (as defined by the CCPA), which means displaying advertising to you based on information obtained based on your activities or inferred from your activities over time across different websites, apps, and onlines services we do not operate.
  • Right to Correct Inaccuracies. Subject to some exceptions, you have the right to request that we correct inaccurate Personal Information that we maintain about you.
  • Non-Discrimination. You have the right not to be discriminated against in exercising your rights under the CCPA, including denial, different pricing structure, different quality, or different level of service. We must provide the same level of access and service to all consumers regardless of which rights they exercise.
  • Minor’s Request for Removal. If you are a CA Resident under the age of 18 that has registered to use our Service or has posted content or information on our Service, you can request removal by contacting us at the contact information provided below. The request should detail where the content is posted and attest that you posted it. We will then make a reasonably good faith effort to remove the post from public view or anonymize it, so the minor cannot be identified to the extent required by law. This removal process cannot ensure complete removal, as the content may have been republished or arched by search engines.

Additionally, California’s Shine the Light Law (Civil Code Section 1798.83) permits CA Residents that use our Service to request certain information regarding our disclosures of Personal Information to third parties for their direct marketing purposes or to opt out of such disclosing this information to third parties. Please contact us to make such a request. If you wish to not have your personal information shared for direct marketing purposes, you may adjust your preferences or request that we delete your personal information.

Unless the request is excessive, repetitive or unfounded, handling of the requests can be exercised free of charge. If we determine that the request requires a fee, we will inform you, and we reserve the right to either refuse to act on your request or charge you a reasonable fee to complete your request.

Only you, or a person registered to act on your behalf, may make a verifiable consumer request related to your Personal Information. We may deny a request for information if we cannot verify your identity or authority. Any request made through your Account (as defined in the Terms of Service and Privacy Policy)) will be considered verified. You may only make a consumer request for access or data portability twice within a 12-month period. To verify your request, we may ask you to provide information such as your name, street address, city, state, zip code, and e-mail address or phone.

Your request must include sufficient detail for us to properly understand, evaluate, and respond to it. If we are not able to verify your request, we will contact you for more information. If we are unable to verify your identity or authority to make the request and confirm the California Personal Information relates to you, we may not be able to respond to your request.
